Privacy Policy

I. Introduction

This privacy policy applies to the Artrepreneur platform, including our initiatives, such as ATP.art and the Readymade Store, along with all related websites, software applications, newsletters, blogs, materials, and services offered by Artrepreneur currently and in the future. Capitalized terms used but not defined herein have the respective meanings ascribed to such terms in the Artrepreneur Terms of Service.

By engaging with our services, you consent to the practices outlined in this policy regarding collecting, using, and protecting your information. We also recognize the importance of third-party services in enhancing your experience with Artrepreneur and note that using such services may require acceptance of their terms and privacy policies, which are beyond our control. We encourage a thorough review of any third-party terms before engagement.

II. Eligibility and Membership Requirements:

Access to and use of the Services provided by Artrepreneur, including ATP.art and the Readymade Store, requires compliance with specific eligibility criteria. This primarily involves membership with the Artrepreneur platform. While ATP.art integrates closely with Artrepreneur, sharing certain data and services, the Readymade Store operates independently on the Shopify platform. Consequently, transactions and interactions within the Readymade Store are subject to Shopify’s privacy practices.

Users are advised that certain actions or features across Artrepreneur, ATP.art, and the Readymade Store may require an Artrepreneur account or a specific membership level. Moreover, all users, regardless of the platform or service, must adhere to age restrictions outlined in the Terms of Service to comply with legal standards for the protection of minors.

III. Collection of Information

Our Services, including Artrepreneur.com, ATP.art, and the Readymade Store, collect information to offer and improve our services to you. Here’s how we handle your information:

  • Personal Information: When you use any part of the Artrepreneur platform, including ATP.art, we might collect Personal Information you provide, such as your name, address, email, or phone number. This can happen through direct submissions, creating an account, or through transactions on the Readymade Store powered by Shopify. Personal Information helps us tailor your experience and respond to your needs across our services.
  • Non-Personal Information: We gather Non-Personal Information like your browser type and operating system through cookies and other technologies across all our services. This information helps us understand how you interact with our sites and improve your user experience. For users engaging with ATP.art, information specific to your use of WordPress might be collected to enhance service delivery.
  • Transaction Information: Specifically for the Readymade Store, transaction-related information is collected through Shopify to process your purchases. This may include payment information, order details, and shipping addresses, necessary for completing your transactions and providing customer support.
  • Choice and Consent: Submitting your Personal Information is voluntary. While opting out may limit some service features, it won’t restrict access to public areas of our platforms. You can manage cookie preferences through your browser settings to limit Non-Personal Information collection.

IV. Use of Collected Information

We will not share or disclose your Personal Information and/or Non-Personal Information to anyone except as described in this privacy policy. We use your Personal Information to personalize and improve the Services and your experiences using the Services, including ATP.art and the Readymade Store, delivering promotions and personalized content to you, responding to your inquiries and requests, and for administrative purposes.

In order to provide you with the Services, we may share your Personal Information with certain authorized third parties, including, without limitation, Third-Party Service providers (“Authorized Third Parties”) who are authorized to act on behalf of Artrepreneur in connection with the Services, ATP.art, and the Readymade Store.

If you do not want us to use your Personal Information as provided in this privacy policy or as stated in the Terms, you should not use any specific page, feature, tool, or application of the Services that collect Personal Information, such as forms requesting Personal Information (for example, creating a Member Account).

Certain features of the Services, including ATP.art and the Readymade Store, may allow you to provide Personal Information to others, and any such Personal Information so provided to others may not be under our control.

We may use Non-Personal Information submitted by you or gathered by cookies to deliver advertisements to you on and/or off of the Services, including ATP.art and the Readymade Store.

From time to time, we may use Non-Personal Information to conduct research surveys through email invitations, pop-up surveys, and online focus groups (each a “Survey”) for our internal use. When participating in a survey, we may ask you to enter your Personal Information. The Personal Information you submit in a Survey may be used by us and/or Authorized Third Parties for research and measurement purposes, including, without limitation, to measure the effectiveness of content and features we provide as part of the Services, Third-Party Services, and/or other websites and other services offered by us. When a survey collects personal information, we will not knowingly accept participants under the age of 13. This privacy policy will bind surveys conducted by or on behalf of us. If your web browser is not enabled to accept cookies, you may not be able to participate in a Survey.

We may use aggregated Non-Personal Information in order to improve the Services, Third-Party Service offerings, and for business and administrative purposes. Non-Personal Information that we collect about you may be combined by us with other information available to us through third parties for administrative, research, and measurement purposes, including, without limitation, improvement of the Services and other services offered by us. This information from other sources may include age, gender, demographic, geographic, or other information. We may also use or share any such aggregated information that does not contain Personal Information with third parties for any purpose.

The information collected through Cookies is used primarily to improve the features of the Services, including ATP.art and the Readymade Store, and to help Artrepreneur understand how users interact with them. This information is collected for statistical analysis to determine what information and features of the Services are of most and least interest to our users and to improve the utility of the features of the Services.

At various times when you provide us with Personal Information and/or when you use the Services, including, but not limited to, your attendance at any outside event affiliated with Artrepreneur, any Artrepreneur-affiliated webinar, or signing up to the Artrepreneur platform via the creation of a Member Account, you will be given the option of providing us with Personal Information in order to receive recurring informational or promotional newsletters via email, or otherwise through mobile applications, from us and/or directly from third parties (“Newsletters”). When you sign up for newsletters or use the services thereafter, you can choose to opt out of receiving newsletters from us and/or third parties. You can unsubscribe from newsletters by following the unsubscribe link in the newsletter. We will take commercially reasonable steps to implement your opt-out and unsubscribe requests promptly, but you may still receive communications from us for up to ten business days as we process your request. Third parties (including Third-Party Service providers) may also use cookies on their websites and software applications. Artrepreneur is not able to control any third party’s use of such technologies or how any third party manages the information gathered from such technologies. You should review the terms of service, privacy policies, and other similar documents of any such third party and make your own informed decision about whether to continue sharing your information with such third party based on their business practices.

We may transfer Personal Information as an asset in connection with a proposed or actual acquisition of Artrepreneur (including any transfers made as part of an insolvency or bankruptcy proceeding) involving all or part of our business or as part of a corporate reorganization or other change in control of Artrepreneur.

V. Emails You Send Us

This privacy policy does not apply to documents, content, business information, ideas, concepts, inventions, or other materials (collectively, “User Materials”) that you send to us by email or other electronic communications, such as through a mobile application (together, “Email”), or share with others. If you want to keep User Materials private or proprietary, do not send them to us in an Email or share them with others. Do not send us Personal Information by email.

VI. Distribution of Information

We will not use, sell, transfer, or otherwise disclose your information without your consent, except as stated herein or in the Terms. Additionally, we reserve the right to disclose any information in order to comply with a subpoena, court order, administrative or governmental order, or any other requirement of law or when we, in our sole discretion, believe it is necessary in order to protect our rights or the rights of others, to prevent harm to persons or property, to prevent fraud, investigate actual or suspected security breaches, and for any matter involving a claim of personal safety or litigation where Personal Information is relevant. We may be obligated under certain applicable laws to notify you and the authorities in the event of a security breach.

Commitment to Data Security. 
We are committed to protecting the information we receive from you. We follow commercially reasonable technical and management practices to help protect the confidentiality, security, and integrity of data stored on our system. While no computer system is completely secure, we believe the measures we have implemented reduce the likelihood of security problems to a level appropriate to the type of data involved. We use security measures to protect against loss or misuse of your information (including Personal Information) and to keep it secure. Additionally, only authorized employees and third parties who need access to your information to perform their duties are allowed access.

We will retain your Personal Information as long as needed to provide the Services to users and our other business purposes, but we do not guarantee that we will retain your Personal Information for any specific period of time, except as may be required under certain applicable laws. At any time, you can request the removal of your Personal Information or instruct us to remove it, but you should be aware that it might not be reasonably possible to remove each and every record of the information you have provided to us from our servers and platform.

We will also retain your Personal Information as necessary to comply with legal obligations, resolve disputes, and enforce our agreements.

VII. Accessing and Updating Your Personal Information

You hold the responsibility for authorizing, monitoring, and controlling access to your hardware systems, devices, and your Artrepreneur Member Account, including any interactions you may have with ATP.art and the Readymade Store. Taking appropriate measures to safeguard your systems, devices, passwords, and other account information is crucial.

You can access and update your Personal Information, user account settings, and preferences for receiving advertisements, Newsletters, Surveys, or other communications from us across all platforms, including Artrepreneur, ATP.art, and the Readymade Store. This can be done by logging in to the Services and/or contacting us.

If you wish to delete any of your Personal Information, deactivate your password, or deactivate your Member Account, please log in to your Member Account to make these changes. Should you need assistance or have specific requests related to ATP.art or the Readymade Store, you may also reach out to us for further support.

VIII. Children’s Privacy and Parental Controls

We do not solicit any Personal Information from children, and no part of the Services is directed to children younger than 13 years old. If we learn that we have collected the Personal Information of a child younger than 13 years old, we will take steps to delete such information from our files as soon as possible. If you are a child younger than 13 years old, you should not submit any Personal Information to us through any feature of the Services or otherwise. We strongly urge all parents and legal guardians to monitor their children’s Internet use. Parents should be aware that there are parental control tools available from other sources on the Internet that they can use to prevent their children from submitting information online without parental permission or from accessing certain material on the Internet.

IX. Privacy Policy Changes

We may change this privacy policy in accordance with the Terms, and your continued use of the Services indicates your acceptance of and agreement to any changes to this privacy policy. Notwithstanding the foregoing, if you have registered to use the Services with a valid email address, we will use our best efforts to notify you. Please delete your account if you choose not to accept the revised privacy policy. If you do not provide or maintain a valid email address, we may not be able to provide you with any notifications of changes or revisions to the privacy policy.

X. Users from Outside the United States

The Services are directed to and are for use by only users in the United States. Certain laws of the United States and the State of New York govern the use of the Services. If you use the Services outside of the United States, please be aware that any information we collect (including Personal Information) may be transferred to, stored, and/or processed in the United States.
